1. CORPORATE OFFICES
MaineCom Services or MaineCom
(the "Company") has its offices located at 245 Commercial Street, Suite #203,
Portland, ME 04101. Mail may be sent to the Company at the same address.
2. PAYMENT OBLIGATION
The provision of facilities or
services by the Company for any purpose, at any location, is contingent upon
payment of all charges detailed in any agreement or future Rate Schedule
applicable to the location and character of service. The company primarily
bills in advance for services provided. Unless otherwise specifically provided
in an agreement or rate, bills for facilities or services shall be net and
shall be due and payable upon presentation.
3.RESIDENTIAL CUSTOMERS EXCLUDED
The Company has no Residential
customers.
4. DEPOSITS FROM NON-RESIDENTIAL CUSTOMERS
a). The Company's right to
require a deposit from a non-residential customer shall be governed by MPUC
Rules, Chapter 860 - Disconnection and Deposit Regulations for Non-residential
Utility service, a copy of which is available at the business office of the
Company.
b). The Company will pay
interest on all customer cash deposits at such rate and intervals as specified
by MPUC Rules, Chapter 870 - Late Payment Charges, Interest Rates to be Paid on
Customer Deposits, and Charges for Returned Checks, a copy of which is
available at the business office of the Company. The Company will apply any
newly specified rate to all deposit amounts on bills issued after the effective
date of the new rate.
5. LATE PAYMENT CHARGES
a). Non-residential bills not paid
within 30 days from the postmark date on the customer's bill shall be subject
to a late payment charge on the unpaid balance at the maximum rate specified by
the MPUC pursuant to Chapter 870 of the Commission's rules. The Company will
apply any newly specified rate to all overdue amounts billed after the
effective date of the new rate.
b). No late fees will be
applied on any bill properly disputed by a customer according to Commission
rules. A customer will have 25 days from the date of resolution of the dispute
to remit payment in order to avoid a late payment charge on this amount.
c). No late fee will be applied
to overdue amounts smaller than one hundred dollars ($100.00).
6. CHARGES FOR RETURNED CHECKS
If a bank dishonors a check
presented to the Company by a customer, the Company will charge the customer
the greater of five dollars ($5.00) per account to which the check was applied,
or the amount that the bank charged the company, but not greater than fifteen
dollars ($15.00), as specified in MPUC Rules, Chapter 870.
7. DISCONNECTION BY THE COMPANY
a). The disconnection of a
non-residential customer and provisions for restoration of service shall be
governed by MPUC Rules, Chapter 860 - Disconnection and Deposit Regulations for
Nonresidential Utility Service, a copy of which is available at the business
office of the Company.
b). As a condition precedent to
the restoration of service discontinued by the Company for reason of
non-payment of bills, danger to the Company's property, or dangerous conditions
on the customer's premises, the Company may require payment of a Reconnection
charge equal to the actual costs of such reconnection, but in no case less than
one hundred and twenty-five dollars ($125.00) during normal business hours or
two hundred and twenty-five dollars ($225.00) outside of normal business hours.
8. AGREEMENTS WITH CUSTOMERS FOR SERVICE
Services provided by the Company
include construction and sale of fiber optic facilities for the private use of
customers and lease of new or existing so-called "dark fiber" to private
customers, carriers, and the like. Signed agreements are required for either
type of service, and the forms of agreements are attached as Exhibit A for
"Private Communication Facilities" and Exhibit B for "Private Fiber
Lease". Signed agreements which do not materially differ from the attached
Exhibits A and B will be effective in accordance with their terms and will not
require filing with or approval by the Maine Public Utilities Commission.
